New Jersey Bill Targets Sweepstakes Casino Regulation

### The Essentials at a Glance

A new bill in New Jersey, Bill A5196, aims to regulate so-called sweepstakes casinos. These platforms currently operate in a legal grey area, raising concerns about consumer protection, youth safety, and tax evasion. If the bill is passed, New Jersey would become the first U.S. state to legalize and oversee this type of casino. The regulation could fundamentally reshape the market by displacing unlicensed operators and fostering partnerships with land-based casinos.

### What Are Sweepstakes Casinos?

Sweepstakes casinos differ from traditional online casinos. Players use free or purchased tokens to participate in games like slots or table games. This structure allows them to bypass traditional gambling laws. However, critics argue that this leads to issues such as inadequate consumer protection, insufficient youth safeguards, and potential economic harm to the state.

### Purpose of the Bill

Bill A5196, introduced by Assemblyman Clinton Calabrese, seeks to eliminate this grey area. In the future, sweepstakes casinos would need to apply for a license and comply with New Jersey’s gambling laws. Oversight would be handed to the New Jersey Division of Gaming Enforcement (DGE). Additionally, regulated providers would be required to collaborate with land-based casinos to meet legal requirements.

Calabrese emphasized the urgency of regulation: “Sweepstakes casinos have been operating in a regulatory grey area, which has led to significant challenges, including consumer protection issues, youth safety concerns, and economic losses for the state.”

### Impact on the Market

If the bill is implemented, it could have a lasting impact on the market. Licensed operators would need to pay fees and adhere to strict regulations, likely pushing unregulated platforms out of the market. At the same time, partnerships with land-based casinos could lead to conflicts, as traditional operators may fear additional competition.

### Support from the Industry

The Social and Promotional Games Association (SPGA), an advocacy group for social and promotion-based games, has expressed its support for the bill. Camilla Wright, a spokesperson for the SPGA, highlighted that many operators already use technologies and processes to ensure a safe gaming experience. Regulation would further enhance these efforts and promote greater transparency.

### Legal Challenges

The bill has also been fueled by a recent lawsuit filed by a New Jersey resident, Julian Bargo. He accuses several sweepstakes casinos of deceptive business practices and also alleges that Google and Apple hosted these platforms. The lawsuit invokes the RICO Act (Racketeer Influenced and Corrupt Organizations Act), which is used to combat organized crime.

### Next Steps

For the bill to take effect, it must clear several legislative hurdles and receive approval from Governor Phil Murphy. Amendments to the bill could be made during the legislative process. If passed, the law could serve as a model for other states looking to regulate similar platforms.

### Our Assessment

Regulating sweepstakes casinos in New Jersey is a long-overdue step. The current grey area poses significant risks for both players and the state. Clear rules could enhance consumer protection and transparency while driving illegal operators out of the market. However, it remains to be seen how traditional casinos will respond to the potential competition and whether the bill will pass in its current form. The coming months will be critical in shaping the future of this growing market.
